It is easier to get caught out buying an illegal property in Spain, than first meets the eye.
There are estimated to be well over 100,000 illegal properties in Spain
Many people caught up, have done every thing by the book and still ended up with an illegal property
Below are a couple of tips to help try and avoid this. Some may be simple, over looked methods, others just common sense
Tips to avoid being caught out
Research the area you looking at buying in.
Visit local bars and speak to Ex Pats already living in the area you looking at buying your property in and find out if there are any illegal buildings in the area or find out what estate agents etc are recommended etc
Check the internet for chat rooms and forums, for the town or area your looking at buying in. And ask questions there. Most of the internet forums are free to join and use.
Be courteous and polite when using the forums. You will as a rule of thumb get a warm welcome and a better response to your questions
What Next
Legal advice, a lot of estate agents include legal services in the price of the house or recommend solicitors. Our advice will upset a lot of estate agents.
Shop around for a solicitor. We even recommend finding one in your own country. This serves two purposes. One the solicitor will speak your language and secondly they will be a lot easier to contact and deal with for any paper work. Or if your looking for a solicitor in the area your buying your house, ask around and see who people recommend or contact an estate agent from the next town. They will be less likely to have any interest’s in the town your buying in.
A misconception
The advice of getting a Spanish mortgage on your property, because the banks would not lend out their own money if they could loose it. Again, this could end up with being a misconception. Because the person the money is lent to is still held liable for the repayments, if the property is deemed illegal and bulldozed. You also get the bulldozer fee’s along with being left to pay the mortgage
Some mortgage lenders have sections written into their contracts saying that the person the money is lent to will be held liable for full repayment, even if the property gets demolished
