We heard of people receiving letters and wondered just how those letters were passed on, then we found out
In our own case, we had had the local police round checking the details on all the houses on the plot of land our house shares with six other houses, all built by the same builder.
On the last visit by the police, they issued one home owner with a letter. This letter even though only given to one person, covered every property on the plot or estate
Any letter you receive, act immediately and seek legal advice
Do not use use the solicitor that acted on your behalf to purchase the house, at a later date this could be classed as collaboration.
Appointment of a solicitor is a very personal thing, but below are some questions you should ask
Are they a bar society/ association registered Abogadas? Please ensure they are an Abogados and not a Gestoria, as this person may not be able to act on your behalf in court at a later date, if needed
Are they urbanistic qualified? Ie studied at Masters Level with update courses on new laws
Have they any experience of dealing with such problems as infraction files, government summons letters and demolition orders, if so when and where.
What results did they archive in the cases they dealt with?
Ask them to explain the process they will undertake to ensure your house is legalised
Written quote for the full process that is on headed paper, dated, signed and prepared against the Bar Association rules, regulations and fee structure
If you are facing financial difficulties, are they prepared to accept payment by negotiated instalments
The British Consulate can provide a list of recommended Abogadas, but please bear in mind they may not be urbanistic specialists
